Welcome to Sunn Fitness. Our mission is to provide you with high-quality gym training programs and activity monitoring to help you perform your best while minimizing the risk of injury.
TL;DR: The Quick Version
Safety First: We are a software tool, not a clinical healthcare provider. You assume all physical risks associated with exercise.
Your Data: Securely stored in Canada. We use anonymous, aggregated stats for research to improve our algorithms, but we never sell your identifiable personal data.
Subscriptions: Transparent 14/30 day trials. Auto-renews unless cancelled. We follow 2026 "Click-to-Cancel" rules for hassle-free exits.
Intellectual Property: Our workout videos, code, and activity monitoring algorithms are proprietary. No scraping or redistribution allowed.
Age: 12+ only. Users under 18 may only use the app under the supervision of a parent/guardian.
1. CONTRACTUAL RELATIONSHIP & ELIGIBILITY
TL;DR:
By using the app, you are signing a legally binding contract.
You must be 18+ or have a guardian's permission to train.
1.1 Acceptance of Terms. These Terms of Service ("Terms") constitute a legally binding agreement between you and Sunn Fitness Inc. ("Sunn Fitness", "we", "us"). By downloading, installing, or using the Sunn Fitness mobile application (the "App") or any related web services (collectively, the "Services"), you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree to these terms, you may not use the Services. Sunn Fitness may update these terms periodically, and may terminate these Terms or any Services with respect to you, or generally cease offering or deny access to the Services or any portion thereof, at any time for any reason.
1.2 Eligibility. You must be at least 18 years of age, or the age of legal majority in your jurisdiction, to form a binding contract. If you are between the ages of 12 and 18, you may only use the Services under the supervision of a parent or legal guardian who agrees to be bound by these Terms.
1.3 Account Security. You are responsible for maintaining the confidentiality of your login credentials. You agree that all activities occurring under your account are your responsibility. Sunn Fitness shall not be liable for any loss or damage arising from unauthorized access to your account resulting from your failure to secure your credentials.
1.4 Duty to Maintain Accurate Account Information. To ensure the proper functioning of our safety protocols, you must keep your account information current. You must promptly update your profile or notify us at hello@sunnfitness.com if there are changes to your legal name, age, or contact email. Sunn Fitness is not liable for service interruptions or compliance failures resulting from your provision of outdated or false information.
3. MEDICAL DISCLAIMER & ALGORITHMIC TRANSPARENCY
TL;DR:
We are a software tool, not a doctor or a clinic – we cannot give medical advice.
Consult a physician before starting, especially if you have a history of heart, joint, or respiratory issues.
3.1 Not Medical Advice. Sunn Fitness is a fitness technology provider, not a medical organization or a licensed personal training studio. The Services, including but not limited to workout plans, activity monitoring, and biometric analysis, are for informational and educational purposes only. They do not constitute medical advice, clinical diagnosis, or physical therapy.
3.2 Specific Health Contraindications. While Sunn Fitness provides data-driven workout suggestions, the App is intended only for users in good general health. You represent and warrant that you do not suffer from any condition that would make high-intensity resistance training unsafe. Specifically, you should consult a physician before use if you have a history of: (i) cardiovascular or respiratory disease; (ii) spinal, joint, or neuromuscular disorders; or (iii) any recent surgical procedures. If you experience chest pain, severe shortness of breath, or sharp joint pain during a workout, stop immediately and seek medical attention.
3.3 FDA & Regulatory Disclosure. Our activity monitoring and workout generation algorithms have not been evaluated by the U.S. Food and Drug Administration (FDA), the Health Canada Medical Devices Bureau, or any other global health authority. These tools are intended for general wellness and are not designed to "predict" or "prevent" specific medical injuries with clinical certainty.
3.4 Algorithmic Logic. Our systems utilize self-reported data (goals, weight, fatigue levels) and user selected parameters (time of session, day of week, etc) to suggest training programs. You acknowledge that these suggestions are automated and cannot account for latent injuries, nutritional deficiencies, or environmental hazards.
4. ASSUMPTION OF RISK & LIMITATION OF LIABILITY
TL;DR:
Heavy lifting has inherent risks; you assume all responsibility for physical outcomes.
You are responsible for inspecting your gym equipment before use.
You should use a spotter for all sets performed to failure or for "over-the-body" lifts like squats and bench presses
4.1 User Responsibility for Physical Environment. Sunn Fitness provides the content, but you provide the execution. You are solely responsible for ensuring your physical environment is safe, your equipment is in good repair, and your execution of movements matches the safety guidelines provided in our instructional videos. You acknowledge that Sunn Fitness has no control over the physical space, equipment, or manner in which you perform exercises.
Equipment Integrity. You are solely responsible for inspecting all equipment (e.g., racks, cables, benches, and weights) before use. Sunn Fitness is not liable for injuries resulting from mechanical failure or improper gym maintenance.
Spotter Use. For any set performed at a high RPE (Rate of Perceived Exertion) or to technical failure—specifically involving "over-the-body" lifts like the bench press or squats—you agree to utilize a competent human spotter. You assume all risks associated with training "to failure" without physical supervision.
4.2 Physical Activity Risks. You acknowledge that physical exercise, especially gym training involving heavy weights and high-intensity movements, carries inherent risks including but not limited to muscle strains, ligament tears, bone fractures, cardiovascular incidents, or permanent disability.
4.3 No Warranties. The Services are provided “as is” and “as available”. Sunn Fitness disclaims all representations and warranties, express, implied, or statutory, not expressly set out in these terms, including the implied warranties of merchantability, fitness for a particular purpose and non-infringement. In addition, Sunn Fitness makes no representation, warranty, or guarantee regarding the reliability, timeliness, quality, suitability, or availability of the Services, or that the Services will be uninterrupted or error-free. Sunn Fitness does not guarantee the quality, suitability, safety or ability of third party providers. You assume the entire risk arising out of your use of the Services, to the maximum extent permitted under applicable law.
4.4 Limitation of Liability. SUNN FITNESS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, EXEMPLARY, PUNITIVE, OR CONSEQUENTIAL DAMAGES, INCLUDING LOST PROFITS, LOST DATA, PERSONAL INJURY, OR PROPERTY DAMAGE RELATED TO, IN CONNECTION WITH, OR OTHERWISE RESULTING FROM ANY USE OF THE SERVICES. OUR MAXIMUM AGGREGATE LIABILITY UNDER OR IN CONNECTION WITH THESE TERMS (INCLUDING YOUR USE OF THE APP) WHETHER IN CONTRACT, TORT (INCLUDING NEGLIGENCE) ANY CAUSE OF ACTION OR OTHERWISE, OR UNDER ANY THEORY OF DAMAGES, SHALL IN ALL CIRCUMSTANCES BE LIMITED TO THE AMOUNT YOU PAID FOR THE SERVICES IN THE LAST TWELVE (12) MONTHS.
5. SUBSCRIPTIONS, TRIALS, & "CLICK-TO-CANCEL"
TL;DR:
Trials auto-renew into paid plans unless you cancel 24 hours before they end.
Quitting is as easy as joining - no phone calls required.
5.1 Billing Cycles. Sunn Fitness offers monthly and annual subscription plans. Payments are processed via third party service providers such as the Apple App Store or Google Play Store (“Service Providers”). By initiating a subscription, you authorize our Service Providers to charge your payment method on a recurring basis.
5.2 Trial Mechanics.
14-Day Standard Trial: Available to most new users.
30-Day Referral Trial: Available only via verified referral links from existing members.
Conversion: Your trial will convert to a full-price paid subscription on completion of the trial period unless you cancel.
5.4 Cancellation and Refund. You may cancel your subscription at any time and we may suspend or terminate your account at any time at our sole discretion. Charges are non-refundable, other than in compliance with statutory "cooling-off" periods in jurisdictions like the EU, UK, and South Korea (see Section 9).
6. THIRD PARTY SERVICES
TL;DR: You may be subject to the terms of the Google Play Store or the Apple App Store.
The Services may be made available or accessed in connection with third party services and content (including advertising) that Sunn Fitness does not control. You acknowledge that different terms of use and privacy policies may apply to your use of such third party services and content. We do not endorse such third party services and content and in no event shall Sunn Fitness be responsible or liable for any products or services of such third party providers. Additionally, Apple Inc. may be a third-party beneficiary to this contract if you access the Services using Applications developed for Apple iOS. This third party beneficiary is not party to this contract and is not responsible for the provision or support of the Services in any manner. Your access to the Services using these devices is subject to terms set forth in the applicable third party beneficiary’s terms of service.
6. DATA HANDLING & RESEARCH
TL;DR: Your data lives in Canada. We use anonymous data for science to make the app better.
6.1 Canadian Residency & Sovereignty. Sunn Fitness is headquartered in Toronto. All biometric and personal data are stored on encrypted servers within Canada, in material compliance with Canadian privacy and data protection laws.
6.3 Anonymous Research & Data Minimization. We utilize "Purpose Limitation." We only pull the data necessary for your workout suggestions. You consent to the use of anonymized data for clinical-style fitness research and the improvement of our injury-prediction models.
6.4 The "Zero-Sale" Promise. Sunn Fitness will never sell your biometric data or training history to insurance companies, data brokers, or third-party advertisers.
6.5 Privacy Policy. By using the App or accessing the Services, you consent to the terms of our Privacy Policy.
7. INTELLECTUAL PROPERTY & PROHIBITED CONDUCT
TL;DR: We own our videos and code. Don't use our app to train your own AI or build a competitor.
5.1 Sunn Fitness Proprietary Rights. All instructional videos, the Sunn Fitness "Risk Algorithm," UI/UX designs, and proprietary databases are the exclusive property of Sunn Fitness Inc. Subject to these Terms, Sunn Fitness grants you a limited, non-exclusive, non-sublicensable, revocable, non-transferrable license to access and use the App on your personal device, solely in connection with your use of the Services, and solely for your personal, noncommercial use.
5.2 Prohibited Uses. You are strictly prohibited from:
Using automated systems (scrapers, bots, or crawlers) to harvest our workout library.
Using Sunn Fitness content to train machine learning models or generative AI systems.
"Mirroring" or redistributing our workout videos on social media or private platforms.
5.3 User-Generated Content (UGC). By uploading progress photos or comments, you grant Sunn Fitness a limited, non-exclusive, royalty-free license to host and display this content within the App or online, including on our social media pages and on our website. We do not claim ownership of your personal photos.
7. YOUTH PROTECTION & PARENTAL GATE
TL;DR: 12-16 year olds get the "Ultra-Privacy" mode by default. Parents are responsible for minor users.
7.1 Age Signal API Integration. We integrate with Apple/Google "Age Signal" APIs to verify user age. Users identified as being under the age of 16 are automatically placed in "Privacy-First Mode," where data collection is limited to the absolute functional minimum.
7.2 Guardian Binding. If you are a parent or guardian of a minor (12-17), you agree to be bound by these Terms and accept full responsibility for the minor's safety and form while exercising.
8. DISPUTE RESOLUTION & BINDING ARBITRATION
TL;DR: If we have a legal fight, it happens in arbitration in Toronto, not in a class-action courtroom.
8.1 Governing Law. These Terms are governed by the laws of the Province of Ontario, and the federal laws of Canada applicable therein.
8.2 Arbitration Agreement. All disputes arising in connection with the Services shall be settled exclusively by arbitration in Toronto, Ontario, subject to the rules of the Arbitration Act, 1991 (Ontario), before a single arbitrator chosen by mutual agreement of the parties. No party to this agreement will challenge the jurisdiction or venue provisions as provided in this section. 8.3 Class Action Waiver. Any claim against Sunn Fitness must be brought in your individual capacity, and not as a plaintiff or class member in any purported class, collective, representative, multiple plaintiff, or similar proceeding (“Class Action”). The parties expressly waive any ability to maintain any Class Action in any forum. The arbitrator shall not have authority to combine or aggregate similar claims or conduct any Class Action nor make an award to any entity or person not a party to the arbitration. Any claim that all or part of this Class Action Waiver is unenforceable, unconscionable, void, or voidable may be determined only by a court of competent jurisdiction and not by an arbitrator. THE PARTIES UNDERSTAND THAT THEY WOULD HAVE HAD A RIGHT TO LITIGATE THROUGH A COURT, TO HAVE A JUDGE OR JURY DECIDE THEIR CASE AND TO BE PARTY TO A CLASS OR REPRESENTATIVE ACTION, HOWEVER, THEY UNDERSTAND AND CHOOSE TO HAVE ANY CLAIMS DECIDED INDIVIDUALLY, THROUGH ARBITRATION.
9. REGIONAL ADDENDA (GLOBAL COMPLIANCE)
A. CANADA (Quebec)
Language Clause: Il est de la volonté expresse des parties que ce contrat soit rédigé en anglais. (It is the express will of the parties that this contract be drafted in English).
Quebec Consumer Protection: Any limitation of liability that is prohibited under the Quebec Consumer Protection Act shall not apply to Quebec residents.
B. UNITED STATES
California (CCPA 2026): California residents have the "Right to Limit Use of Sensitive Personal Information" (Biometrics) to only that which is necessary to perform the Services.
BIPA (Illinois): Our wearable integration complies with the Biometric Information Privacy Act via explicit written opt-in prior to device syncing.
C. EUROPEAN UNION & UNITED KINGDOM
Right of Withdrawal: You have 14 days from the start of a subscription to request a refund, provided you have not utilized the premium features of the App.
Online Safety Act (UK): We maintain strict content moderation and age-gating to comply with the UK’s 2026 safety standards.
D. AUSTRALIA & NEW ZEALAND
Statutory Guarantees: Our Services come with guarantees that cannot be excluded under the Australian Consumer Law. We do not exclude liability for death or personal injury resulting from our gross negligence where such exclusion is prohibited.
E. SOUTH KOREA
Refund Law: We comply with the Act on Consumer Protection in Electronic Commerce. Subscriptions are refundable on a pro-rata basis for any unused "full months" upon request.
